MOTOSPOT® is a community, navigating, and social mobile application (“App”) and website (“Site”) for motorcycle riders.
This Privacy Policy governs the manner in which MOTOSPOT (“Administrator”) collects, uses, maintains and discloses information collected from users (each, a “User”) of the website and the MOTOSPOT mobile app. This privacy policy applies to the Site, App and any online presences, such as our social media profiles, as well as all products and services offered by MOTOSPOT.

We understand that when you use the MOTOSPOT App or Site you are placing your trust in us to handle your personal data appropriately. That is why Administrator takes a best practices approach to data protection. We make sure that you, the motorcycle rider, have information about how we process personal information in connection with your use of our App and the Site. Because MOTOSPOT has App and Site users worldwide, we made the decision to offer the current highest level of privacy protection, as legislated by Europe’s General Data Protection Regulation (“GDPR”) for personal data rights and protection to all our App and Sites users worldwide. We support the California Consumer Privacy Act (“CPPA”) and provide you with the right to “Do Not Sell” your personal information.

Any user wishing to register on the Site or in the App must first read and accept this Privacy Policy conditions. Any User who does not accept the content of this Privacy Policy must refrain from registering on the Site and for the App.
The data Users supply to the Administrator when they register, as well as all data supplied through the Site and the App, are stored in a database held in the name of and owned by the Administrator, who is responsible for the said database.
The Administrator collects and processes Users’ data in order to identify them as users of the Site and the App, and to allow them access to all services offered by the Site and the App.

Use of the Site and the App means that you expressly consent to having your personal data processed by the Administrator for the purpose of allowing the provision in full of the services that are the subject of the MOTOSPOT activity, and processing any requests you may wish to make, such as for example: complying with your request to include your personal data in our databases, enroll you as a registered user on our website, manage you as a client, or answer your request for information.
Users, as the owners of their data, may exercise their rights to access, amend, correct, delete, and challenge the said data. To do this you should contact the Administrator.

Users warrant that the personal data they supply when they register in order to access the App are accurate, truthful, and up to date, and they undertake to update them as necessary, so that they always reflect their current situation.

Personal Information Collected

To create an account to use our Services, we ask you for certain personal data. 4.2 The information requested by MOTOSPOT during registration includes:
  • First and Last Name
  • E-mail address
  • Date of birth (optional)
  • Gender (optional)

The information collected by MOTOSPOT during the use of the platform includes:

  • Own motorcycle (optional), it’s type, maintenance information

Activity-related data such as

  • Location data (GPS)
  • Length and duration of an activity

Additional optional activity information such as:

  • Title
  • Description
  • Marked friends
  • Photos

In order to be able to use location-based services of the mobile application, MOTOSPOT stores the data collected, evaluates it and makes it available to the user within the App as well as on the Site.

Depending on the user-selected privacy setting, this information may only be seen by him, his friends, or the entire MOTOSPOT community (private, friends & public). The user has the option to make the desired privacy setting when completing an activity / trip or creating a section.

Certain information of a user can be viewed on the profile of each MOTOSPOT registered user as well as test users of the Site. This information includes:
  • First and Last Name
  • Profile picture (optional)
  • Cover image (optional)
  • Friends list
  • Motorcycle (optional)
By registering, the User agrees to the MOTOSPOT EULA and Privacy Policy.

By accepting this Privacy Policy, Users expressly authorize the Administrator to send them information concerning offers, activities, promotions, products, services, etc. (by e-mail) that the Administrator considers to be of interest to the User, both from MOTOSPOT and from third parties.
Users may object to receiving communications for commercial and/or promotional purposes at any time by contacting the Administrator.
Persons aged under 14 are not allowed to register and their information may not be used. If you are aged under 14, please do not try to register on the Site or the App and do not supply us with any personal information. Any information which is found to belong to a person aged under 14 shall be deleted as quickly as possible. If you believe we may have information in our possession belonging to a person aged under 14, we would be grateful if you would inform us by contacting the Administrator.

Hyperlinks featured on the application may redirect you to external websites. The administrator accepts no responsibility for the content of the said websites, or the information or services that may be offered on the said websites, which are offered for exclusively informative purposes and under no circumstances shall this entail any relationship between MOTOSPOT and the owners of the said external websites or the owners of the sites where they are hosted.

Location based information

The Service collects your location to create a detailed location history of all of the journeys you have made while using the Service. The Service will use this information for the following purposes only:
  • to operate the Services and to improve and customize your experience with the Services;
  • to improve the experience of other users. The Service may use your route information to improve the accuracy of its mapping and navigation data;
  • to provide you with support and handle requests and complaints;
  • to send you updates, notices, announcements, and additional information related to the Services;
  • to create aggregated and/or anonymous data (where such data does not enable the identification of a specific user);
  • to conduct surveys and questionnaires;
  • to share your submissions with other users of the Services and to facilitate communication between you, the Service and other users;
  • to enforce the Terms of Use;
  • to contact you when MOTOSPOT believes it to be necessary;
  • to comply with any applicable law and assist law enforcement agencies under any applicable law, when MOTOSPOT has a good faith belief that MOTOSPOT’ cooperation with the law enforcement agencies is legally mandated or meets the applicable legal standards and procedures;
  • to prevent fraud, misappropriation, infringements, identity theft and other illegal activities and misuse of the Services;
  • to handle breakdowns and malfunctions;
  • to take any action in any case of dispute, or legal proceeding of any kind between you and the Service, or between you and other users or third parties with respect to, or in relation with the Service;

Use of cookies and hyperlinks

The Site may use cookies when a user is browsing through its pages. Cookies are only associated with the browser of a particular computer (an anonymous user), and are unable to provide the name or any other information about the user. By using cookies, MOTOSPOT is able to recognize the preferences selected by users in previous visits regarding the contents of the Site and can remember these preferences so you don’t have to select them again in subsequent visits. Please consult the instructions and manuals of your browser in order to obtain further information on how users can configure the receipt of cookies on their browser and prevent them from being installed on the hard drive of their computer. The installation of cookies sent from MOTOSPOT is not necessary in order to use the Site, although in this case it will be necessary for the user to make this selection each time he/she accesses the Site. Cookies help us to understand how you interact with our Services and are also used to store your screen name (but never your password) to make it easier for you to login whenever you come back to Services.

Legal Requirements

We may preserve and share your information with third parties, including law enforcement, public or governmental agencies, or private litigants, within or outside your country of residence, if we determine that such disclosure is allowed by the law or reasonably necessary to comply with the law, including to respond to court orders, warrants, subpoenas, or other legal or regulatory process. We may also retain, preserve or disclose your information if we determine that this is reasonably necessary or appropriate to prevent any person from death or serious bodily injury, to address issues of national security or other issues of public importance, to prevent or detect violations of our Terms of Use fraud or abuse of MOTOSPOT or its App and Site users, or to protect our operations or our property or other legal rights, including by disclosure to our legal counsel and other consultants and third parties in connection with actual or potential litigation.

Encryption & Security

We use a variety of technical and organizational security measures, including encryption and authentication tools, to maintain the safety of your personal data. Your personal data is contained behind secured networks and is only accessible by a limited number of persons who have special access rights to these systems.

Personal Data Retention

We retain information as long as it is necessary to provide the Services to you and others, subject to any legal obligations to further retain such information. Information associated with your account will generally be kept until it is no longer necessary to provide the Services or until your account is deleted.
In addition, you can delete some items of information (e.g., profile information) and you can remove individual activities from view on the Services without deleting your account. Following your deletion of your account, it may take up to 90 days to fully delete your personal information and system logs from our systems. Additionally, we may retain information to comply with the law, prevent fraud, collect fees, resolve disputes, troubleshoot problems, assist with investigations and take other actions permitted by law. The information we retain will be handled in accordance with this Privacy Policy.

Changes to the data protection policy

The Administrator reserves the right to amend and/or change the security and data protection policy in order to adapt it to any legislative reforms or new caselaw, or to any innovations in the standard-form codes existing in this matter, or as a result of strategic corporate decisions, and for this purpose it shall be sufficient for any such amendment and/or change to be published in the Privacy Policy section of the website, with immediate effect as from the date of publication.
However, at the discretion of MOTOSPOT, and without prejudice to the foregoing, additional notice of the changes and/or amendments may also be given by e-mail.
